GravityX Indoor Trampoline Park Pty Limited is a supplier of recreational and other related services under the Australian Consumer Law. These terms and conditions are made between GravityX Indoor Trampoline Park Pty Limited (referred to as “GravityX”, “the Supplier” and “we/us”) and You (also referred to as “the customer”). These terms and conditions affect your legal rights and it is important that you read and understand them before participating in any recreational activities at GravityX. By purchasing an entry ticket from GravityX and by using any of the facilities at GravityX you are deemed to have understood, acknowledged and accepted ALL Safety Rules and Terms and Conditions. Failure to comply with any of the Safety Rules or Terms and Conditions of Entry may result in expulsion from the premises.

  1. To the maximum extent permitted by law, GravityX, its employees, directors and agents (the Supplier) are not liable to any claim of the Customer, his/her dependents or legal representatives in negligence, breach of contract or statute or statutory duty (including for breach of consumer guarantees implied by the Act) suffered by the customer for personal injury or death, any direct/indirect or consequential loss or damage including without limitation of financial loss (such as loss of profits or use of capital or revenue or otherwise),or for any punitive, exemplary, special or incidental loss or damage whether such liability arises in contract, tort (including negligence), equity, from its supply of Recreational Activities including the condition, layout, construction, design, maintenance and use of trampolines and surrounds or the presence of people or objects thereon or nearby or any associated activities, or any similar leisure time pursuits associated in any way with being in the GravityX facility.
  2. The Customer acknowledges that the Recreational Activities are dangerous with many inherent risks, dangers and hazards and personal injury (and sometimes death) can occur and the Customer assumes and accepts all risk of personal injury or death from Recreational Activities, and hereby waives the right to sue the Supplier for any personal injury or death in any way whatsoever arising from such activities. All participants who engage in such recreational activity do so at their own risk.
  3. By participating in the recreational activities you acknowledge, agree and understand that the risk warnings contained above constitute a ‘risk warning’ for the purposes of the relevant legislation, including for the purpose of section 5M of the Civil Liability Act 2002 (NSW).
  4. The Customer agrees to pay the cost of and authorises the Supplier to take all steps it considers reasonably necessary to protect his/her welfare in the event of personal injury, including the administration of any emergency medical treatment and ambulance transportation.
  5. Children must be at least 2 years of age to use the facilities. Children younger than 12 years of age must be supervised by a responsible adult. Where you are responsible for such children you agree to be bound by these conditions on their behalf and you will directly supervise them at all times.
  6. All tickets remain the property of the Supplier and cannot be refunded, transferred or resold. They are valid only for the date and time shown and are void if tampered with. GravityX tickets cannot be used by you for advertising, promotion or other commercial purposes without our prior written consent. In the event GravityX needs to cancel a session due to circumstances beyond our control, or for health and safety reasons, you will be offered the choice to reschedule or receive a full refund.
  7. The Customer must comply with all signs located in the premises or other verbal directions given by GravityX staff. You may be asked to leave the premises for non-compliance with these conditions, or for reckless or careless conduct.
  8. You are aware of warnings concerning forces & actions that could aggravate physical conditions such as pre-existing medical conditions, circulatory conditions, heart or lung conditions, recent surgeries, back or neck conditions, high blood pressure, spine, musculoskeletal, head injury, or pregnancy. Pregnant women and participants wearing casts are not permitted on the equipment. You are responsible for managing your own safety, if in doubt please seek medical advice.
  9. Entry to GravityX is at the discretion of management.
  10. GravityX is a NO-SMOKING premises.
  11. GravityX grip socks must be worn to use GravityX equipment. Depending on the condition of the socks, GravityX socks may be reused. This will be at the discretion of GravityX staff. Participants must, at all times, wear the GravityX wristband whilst using the equipment.
  12. No responsibility or liability is taken by GravityX for broken, lost or stolen personal property. This includes any loss or damage to vehicles parked at or near GravityX.
  13. If you purchase an entry ticket to use the GravityX facilities on behalf of another person, you and that person both agree that you make that purchase as an authorised agent and that other person will be bound by the GravityX terms and conditions.
  14. The maximum weight limit for an individual is 110 kg.
  15. No person will be allowed on the premises whilst under the influence of drugs, alcohol, any illegal substances or anything else which may impair their ability to safely engage in the recreational activities at GravityX. You may be removed from the premises for any aggressive or inappropriate behaviour.
  16. If you, or any person in your care, are refused entry to, or are removed from, GravityX then you will not be entitled to any refund of any money paid by you for entry to GravityX.
  17. Management of children with allergies is the responsibility of the parent/guardian.
  18. No food, drink, glassware, eskies or coolers are to be brought onto the premises (exception is a birthday cake for GravityX birthday parties).
  19. Photographs, movies or videos taken for personal use by you on the premises must not be used for any commercial purpose. While on the premises you consent to images and video being taken for security and promotional purposes of yourself, your children and any person for whom you are responsible.
  20. Price and availability information is subject to change without notice.
  21. The use of the GravityX website must not be for any purpose which is unlawful or contrary to the terms and conditions. The information on the website is of a general nature and is subject to change without notice. All prices quoted on the website are in Australian dollars and include GST. The copyright and intellectual property rights of all the content on the GravityX website belong to GravityX.
  22. You are liable for any damage of GravityX property caused by yourself or by children in your care.
  23. GravityX reserves the right to amend these Terms and Conditions of Entry at any time without notice to you. It is your responsibility to review and ensure that you understand these Conditions of Entry. By purchasing tickets or entering the GravityX Trampoline Park Facilities, you consent to be bound by the Terms and Conditions of Entry which are then in existence.
  24. No waiver of any term or condition of these Conditions of Entry will take place unless specifically agreed in writing by GravityX Trampoline Park.
  25. Offers and Promotions :
    1. The offer is not redeemable for cash or credit.
    2. The offer cannot be used in conjunction with any other Voucher, discount or offer.
    3. Standard terms and conditions of entry apply.
    4. Bookings are non refundable and cannot be modified or cancelled once made.
    5. GravityX reserves the right to withdraw, extend or amend the offer at any time.
    6. Not valid for party bookings.
    7. Promotions cannot be backdated or applied to previous transactions.
  26. Competitions:Prizes are not redeemable for cash.
    1. Prizes are not transferable.
    2. If the agreed prize is not available a product of equal or greater value will be provided.
    3. GravityX is not responsible for prizes once they have been dispatched to the winner.
    4. These terms and conditions are to be governed by the laws of the State of NSW of which shall have exclusive jurisdiction. If any part or provision is determined by a court to be invalid or unenforceable, all other parts and provisions shall remain valid and legally binding.
